Selling a Home in Probate — What to Expect
Probate laws vary from state to state. Each county’s probate court has established rules and practices to follow. We hope this general review of basic steps can help you get an idea of what to expect when you sell a home in probate, and where to start.

Pick Your Team.
Choose a probate real estate specialist you can trust. The right agent can save the day with overwhelming regulations, contacting appraisers and inspectors, or when you need honest advice about what does and doesn’t need done to the property to prepare for a sale.
If necessary, an experienced probate attorney can advise you, prepare legal documents, and represent you in probate court.

Appraise Property.
File a Petition for Sale.
To sell a property in probate, you must file a petition with the probate court. With your petition, you must also provide an appraisal of the current value of the property.

It is only with the court’s approval can you list the house on the market or auction it off.

List Property For Sale.
Required disclosures:
• Home is in probate and purchase agreement is contingent on court approval. Your real estate agent will guide you through this.
• Any known issues that impact the value of the house. Your attorney can offer guidance in completing disclosure forms.

Court approval can add a month or more to the sale timeline.

Or Sell Off Market to Cash Investors.
If the situation calls for a “quick sale,” Herzog Estate Services works with a large pool of cash buyers willing to purchase properties “as is” condition with or without the remaining personal property.
We can arrange for almost anything.

Close the Sale.
Only the executor or the court-appointed representative can sign real estate documents on behalf of the deceased. Check the legal description of the property before the deed is recorded with the county. For the deed to withstand any challenges, a perfectly correct real estate legal description MUST be supplied.

Report Sale to IRS.
The distribution of real estate sale proceeds must be accounted for to the IRS. You must pay capital gains taxes from the sale of an inherited property. The IRS taxes the difference between the fair market value and the price at sale. Your probate attorney will be able to advise you on the best way to handle this step.
